Welcome to MyTOPIK. These Terms of Use ("Terms") constitute a legally binding agreement between you and MyTOPIK ("we," "us," or "our") governing your access to and use of our mobile applications (iOS and Android), website, and related services (collectively, the "Service").

Please read these Terms carefully before using MyTOPIK. By downloading, installing, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service, including individual learners and users enrolled through educational institutions or B2B partnerships.

1. Acceptance of Terms

By creating an account or using MyTOPIK, you agree to be bound by these Terms. You represent and warrant that:

• You have the legal capacity to enter into this agreement
• You will comply with all applicable local, state, national, and international laws and regulations
• You are not prohibited from receiving our Service under the laws of any applicable jurisdiction
• All information you provide during registration and use of the Service is accurate and complete

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" will refer to both you individually and that organization.

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use MyTOPIK. Users under the age of 18 (or the age of majority in your jurisdiction) must have their parent or legal guardian review and agree to these Terms on their behalf.

2.2 Parental Responsibility

If you are a parent or legal guardian who has authorized a minor to use MyTOPIK, you agree to:

• Supervise the minor's use of the Service
• Be fully responsible for the minor's compliance with these Terms
• Accept full liability for any activities conducted under the minor's account

2.3 Institutional Users

If you access MyTOPIK through an educational institution, your use may be subject to additional terms established by your institution. In case of conflict between institutional terms and these Terms, the institutional terms will govern to the extent of the conflict.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information to keep it accurate
• Choose a secure password and keep it confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized use of your account

3.2 Account Restrictions

• You may only create one account per person
• Accounts are non-transferable and may not be sold, combined, or shared
• You may not use another person's account without permission
• We may refuse registration or cancel accounts at our discretion

3.3 Account Responsibility

You are solely responsible for all activities that occur under your account. We will not be liable for any loss or damage arising from unauthorized use of your account. You agree to notify us immediately if you become aware of any breach of security or unauthorized use of your account.

4. Service Description

4.1 Overview

MyTOPIK is an AI-powered Korean language learning platform designed to help users prepare for the Test of Proficiency in Korean (TOPIK) exam. Our Service includes:

• TOPIK exam practice: Mock tests for listening, reading, and writing sections aligned with official TOPIK formats
• AI-powered feedback: Automated evaluation and personalized feedback on your responses, particularly for writing exercises
• Progress tracking: Detailed analytics on your performance, strengths, and areas for improvement
• Score prediction: AI algorithms that estimate your potential TOPIK exam score based on practice performance
• Educational content: Vocabulary lists, grammar explanations, and multimedia learning materials
• Gamification features: Streaks, achievements, leaderboards, and other motivational elements
• Personalized recommendations: AI-driven content suggestions based on your learning patterns and goals

4.2 Service Availability

We strive to maintain consistent service availability, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Emergency repairs or security patches
• Technical issues beyond our reasonable control
• Force majeure events

4.3 Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may add, remove, or change features, impose usage limits, or restrict access to parts of the Service. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

6. Intellectual Property

6.1 MyTOPIK's Intellectual Property

The Service and its entire contents, features, and functionality are owned by MyTOPIK and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes, but is not limited to:

• The MyTOPIK name, logo, and brand elements
• All software, code, and underlying technology
• AI models, algorithms, and machine learning systems
• Educational content, including questions, explanations, and materials
• User interface designs and visual elements
• Data compilations and databases
• All improvements and derivatives of the above

6.2 Limited License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include the right to:

• Modify, copy, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any proprietary notices or labels
• Use the Service for any commercial purpose without our written consent
• Transfer your license to any other person or entity

6.3 Third-Party Content

The Service may contain content from third parties, including educational materials, images, and other media. Such content is owned by its respective owners and is used under license or fair use principles. You may not use third-party content outside the context of the Service without the owner's permission.

7. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate laws: Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Harm others: Harass, abuse, threaten, defame, or otherwise harm any person or entity
• Post inappropriate content: Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable
• Impersonate: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Spam: Send unsolicited communications, promotions, advertisements, or spam
• Infringe rights: Upload content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights

7.2 Technical Restrictions

• No unauthorized access: Access or attempt to access accounts, systems, or networks without authorization
• No interference: Interfere with or disrupt the Service, servers, or networks connected to the Service
• No scraping: Use any robot, spider, scraper, or other automated means to access the Service or collect data
• No reverse engineering: Decompile, disassemble, or reverse engineer any part of the Service
• No circumvention: Attempt to bypass or circumvent any security features or access controls
• No malware: Upload or transmit viruses, malware, or any other malicious code

7.3 Academic Integrity

• No cheating: Use bots, scripts, exploits, or any unfair means to gain advantages in tests or leaderboards
• No sharing answers: Share or distribute test questions, answers, or other assessment content outside the Service
• No account sharing: Share your account with others or use another person's account
• Honest representation: Not misrepresent your identity or qualifications

8. Subscriptions and Payments

8.1 Free and Premium Features

MyTOPIK offers both free features with certain limitations and premium subscription plans that unlock additional content and functionality. The features available under free and premium tiers may change from time to time.

8.2 Subscription Terms

• Billing: Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform
• Automatic renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date
• Price changes: We may change subscription prices at any time; changes will apply to the next billing cycle after notice
• Payment processing: All payment processing is handled by Apple or Google; we do not store your payment information

8.3 Cancellation

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to premium features until the end of your paid period
• We do not provide prorated refunds for partial billing periods

8.4 Refunds

Refunds are subject to the policies of the Apple App Store or Google Play Store. Generally:

• Refund requests must be submitted through the respective app store
• We have limited ability to process refunds directly
• Refund eligibility is determined by Apple or Google based on their policies
• Chargebacks or disputed payments may result in account suspension

8.5 Free Trials and Promotions

We may offer free trials or promotional pricing from time to time. These offers are subject to specific terms disclosed at the time of the offer. Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends.

9. AI-Generated Content and Disclaimers

9.1 Nature of AI Content

MyTOPIK uses artificial intelligence to provide various features, including:

• Automated feedback and scoring on writing exercises
• Explanations of grammar and vocabulary
• Score predictions and performance analysis
• Personalized content recommendations
• Natural language responses and explanations

9.2 Limitations of AI

You understand and acknowledge that:

• AI is not perfect: AI-generated content may contain errors, inaccuracies, or inconsistencies
• Not official grading: AI feedback is for educational purposes only and does not represent official TOPIK scoring
• No guarantee of results: We do not guarantee any specific exam scores, learning outcomes, or improvements
• Subjective evaluation: Writing evaluation is inherently subjective, and AI assessments may differ from human graders
• Evolving technology: AI capabilities and accuracy may change over time as we improve our systems

9.3 User Responsibility

You should not rely solely on MyTOPIK's AI feedback for TOPIK exam preparation. We recommend supplementing your study with other resources, including official TOPIK materials and qualified instructors. The ultimate responsibility for your exam preparation and results rests with you.

10. Disclaimers

No advice or information, whether oral or written, obtained from MyTOPIK or through the Service, shall create any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless MyTOPIK and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including any intellectual property, privacy, or property right
• Any User Content you submit through the Service
• Any claim that your User Content caused damage to a third party

This indemnification obligation will survive the termination of these Terms and your use of the Service.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the app settings
• Contacting us at the email address provided below

Upon termination, your right to use the Service will immediately cease. Any premium subscription should be cancelled separately through your app store.

13.2 Termination by MyTOPIK

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct harmful to other users or the Service
• Extended period of inactivity
• At our sole discretion for any other reason

13.3 Effects of Termination

• Your license to use the Service terminates immediately
• You will lose access to your account and any content stored within it
• We have no obligation to retain or provide copies of your content
• Provisions that by their nature should survive (including ownership, disclaimers, indemnity, and limitations of liability) will survive termination

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved as follows:

• Informal Resolution: We encourage you to contact us first to attempt to resolve any dispute informally
• Mediation: If informal resolution fails, both parties agree to attempt mediation before initiating formal legal proceedings
• Jurisdiction: Any legal action shall be brought exclusively in the courts located in Seoul, Republic of Korea
• Language: Legal proceedings shall be conducted in Korean or English

14.3 Class Action Waiver

To the extent permitted by applicable law, you agree to resolve any disputes with MyTOPIK on an individual basis and waive any right to participate in class actions, class arbitrations, or representative actions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will provide notice through the app, by email, or other reasonable means
• Changes become effective upon posting unless we specify otherwise

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyTOPIK regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of MyTOPIK.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 No Third-Party Beneficiaries

These Terms do not confer any rights on any third party. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and MyTOPIK.
